Ten Protest Cases Resolved without Prosecution

BOSTON, June 11, 2014—The 10 men arrested for trespassing at the Massachusetts Department of Transportation headquarters earlier this week will not incur criminal records for the protest-related incident, Suffolk County District Attorney Daniel F. Conley said.
Arrested Monday night at the Park Plaza office building that houses MassDOT were:
1.      An 18-year-old male from Dorchester
2.      An 18-year-old male from the South End,
3.      A 19-year-old male from Roxbury,
4.      A 21-year-old male from Arlington,
5.      A 22-year-old male from Roxbury,
6.      A 33-year-old male from Roxbury,
7.      A 24-year-old male from Cambridge,
8.      A 26-year-old male from Roxbury,
9.      A 28-year-old male from Allston, and
10.  A 28-year-old male from Dorchester
All 10 were charged with trespassing on state property for refusing to leave the fourth floor of that building by 7:00 p.m. despite repeated warnings from State Police that they could not remain inside the building after the close of business. An additional 11 females were also arrested and are expected in court tomorrow. None of the arrestees had prior convicions or warrants. All were cooperative with troopers during the arrest and booking process, and all were bailed from the barracks.
At the request of Assistant District Attorney Susan Terrey, Boston Municipal Court Judge Thomas Kaplanes amended the criminal complaints to civil violations and dismissed them at arraignment, a move that terminates their prosecution and will allow the 10 to maintain clean records, prosecutors said.
Today’s defendants were represented by attorney Neil Berman. Prosecutors expect to recommend the same disposition for the 11 female arrestees tomorrow.
